1. Acceptance of Terms

By accessing or using KloHost Services, you confirm that:

• You are at least 18 years of age or the age of majority in your jurisdiction
• You have the legal authority to enter into this agreement on behalf of yourself or your organization
• You have read, understood, and agree to be bound by these Terms
• You agree to comply with all applicable local, state, national, and international laws and regulations

If you are using our Services on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. In that case, "you" and "your" will refer to that entity.

2. Services Description

KloHost provides the following services, subject to these Terms:

We reserve the right to modify, suspend, or discontinue any Service at any time with reasonable notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of Services.

3. Account Registration

Creating Your Account

To access most KloHost Services, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information to keep it accurate
• Keep your password confidential and secure
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

Account Security

You are responsible for maintaining the security of your account credentials. KloHost will not be liable for any loss or damage arising from your failure to comply with these security obligations. We strongly recommend enabling two-factor authentication (2FA) on your account.

One Account Per Person

Each individual or organization may maintain only one active account. Creating multiple accounts to circumvent service limits, abuse promotions, or evade suspensions is prohibited and may result in termination of all associated accounts.

4. Acceptable Use Policy

Our Services may only be used for lawful purposes. The following table summarizes permitted and prohibited activities:

Conditional activities require prior written approval from KloHost. Violations of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund.

5. Payment & Billing

Pricing & Fees

All prices are listed in US Dollars (USD) unless otherwise stated. Prices are subject to change with 30 days' notice. Applicable taxes will be added to your invoice based on your billing address.

Billing Cycles

Services are billed in advance on a monthly or annual basis, depending on the plan you select. Annual plans are non-refundable after the 30-day money-back guarantee period.

Auto-Renewal

All Services, including domain registrations and hosting plans, are set to auto-renew by default. You will receive renewal reminder emails at 60, 30, and 7 days before expiration. You may disable auto-renewal at any time from your account dashboard.

Failed Payments

If a payment fails, we will attempt to charge your payment method again after 3 and 7 days. If payment is not received within 14 days of the due date, your Services may be suspended. Suspended accounts have a 30-day grace period before permanent deletion.

Refund Policy

• Hosting plans: 30-day money-back guarantee for new customers on first purchase
• Domain registrations: Non-refundable once registered (per ICANN policy)
• SSL certificates: Refundable within 30 days if not yet issued
• Setup fees: Non-refundable

6. Domain Names

Registration & Ownership

When you register a domain through KloHost, you are the registrant and legal owner of that domain. KloHost acts as your accredited registrar. Domain registrations are subject to ICANN's policies and the registry's terms for each TLD.

WHOIS Privacy

We offer free WHOIS privacy protection on eligible domains. When enabled, your personal contact information is replaced with our privacy service details in the public WHOIS database. Note that WHOIS privacy may not be available for all TLDs (e.g., .us, .ca, .de).

Domain Transfers

You may transfer your domain to another registrar at any time, subject to a 60-day lock period after initial registration or transfer (per ICANN policy). To initiate a transfer, unlock your domain and request an authorization (EPP) code from your account dashboard.

Domain Disputes

Domain disputes are handled through ICANN's Uniform Domain-Name Dispute-Resolution Policy (UDRP). KloHost will comply with all valid UDRP decisions and court orders regarding domain ownership.

7. Hosting Services

Uptime Guarantee

KloHost guarantees 99.9% network uptime for all hosting plans, excluding scheduled maintenance windows. If uptime falls below this threshold in any calendar month, you may be eligible for a service credit. Credits are calculated as follows:

• 99.0% – 99.9% uptime: 10% credit of monthly fee
• 95.0% – 99.0% uptime: 25% credit of monthly fee
• Below 95.0% uptime: 50% credit of monthly fee

Resource Usage

Shared hosting plans are subject to fair use policies. Accounts that consistently use excessive CPU, memory, or bandwidth resources that negatively impact other customers may be asked to upgrade to a higher-tier plan or VPS hosting.

Backups

KloHost performs daily automated backups of all shared hosting accounts. Backups are retained for 30 days. While we make every effort to maintain reliable backups, we strongly recommend maintaining your own independent backups. KloHost is not liable for data loss.

Scheduled Maintenance

We perform scheduled maintenance during low-traffic hours (typically 2:00–4:00 AM UTC). We will provide at least 48 hours' notice for planned maintenance that may affect service availability.

8. Intellectual Property

KloHost's Intellectual Property

The KloHost name, logo, website design, software, documentation, and all related materials are the exclusive property of KloHost, Inc. and are protected by copyright, trademark, and other intellectual property laws. You may not use our trademarks or branding without prior written permission.

Your Content

You retain full ownership of all content you upload, publish, or store on KloHost's servers ("Your Content"). By using our Services, you grant KloHost a limited, non-exclusive license to host, store, and transmit Your Content solely for the purpose of providing the Services to you.

Content Responsibility

You are solely responsible for Your Content and must ensure that it does not infringe on any third party's intellectual property rights. KloHost will respond to valid DMCA takedown notices in accordance with the Digital Millennium Copyright Act.

9. Privacy & Data

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Data Processing

By using our Services, you consent to the processing of your personal data as described in our Privacy Policy. If you are located in the European Economic Area (EEA), our processing of your data is subject to GDPR requirements.

Data Retention

We retain your account data for as long as your account is active or as needed to provide Services. Upon account termination, we will delete or anonymize your personal data within 90 days, except where retention is required by law.

Third-Party Services

Our Services may integrate with or link to third-party services (e.g., payment processors, analytics providers). These third parties have their own privacy policies, and we encourage you to review them. KloHost is not responsible for the privacy practices of third-party services.

10. Limitation of Liability

Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KLOHOST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICES.

Maximum Liability

In no event shall KloHost's total liability to you for all claims arising out of or relating to these Terms or the Services exceed the greater of: (a) the total amount you paid to KloHost in the 12 months preceding the claim, or (b) $100 USD.

Indemnification

You agree to indemnify, defend, and hold harmless KloHost and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Services or violation of these Terms.

11. Termination

Termination by You

You may cancel your account and terminate these Terms at any time by contacting our support team or using the account cancellation option in your dashboard. Cancellation takes effect at the end of your current billing period. No refunds are issued for unused portions of prepaid periods, except as provided in our Refund Policy.

Termination by KloHost

We reserve the right to suspend or terminate your account and access to Services at any time, with or without notice, for any of the following reasons:

• Violation of these Terms or our Acceptable Use Policy
• Non-payment of fees after the grace period
• Fraudulent, abusive, or illegal activity
• Actions that harm KloHost, its infrastructure, or other customers
• Requests from law enforcement or government agencies

Effect of Termination

Upon termination, your right to access and use the Services immediately ceases. We may delete your account data after a 30-day grace period. Domain registrations will remain active until their expiration date unless terminated for cause.

12. Disputes & Governing Law

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Dispute Resolution

Before filing a formal legal claim, you agree to attempt to resolve any dispute informally by contacting us at legal@klohost.io. We will attempt to resolve the dispute within 30 days of receiving your notice.

Arbitration Agreement

If informal resolution fails, any dispute arising out of or relating to these Terms shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in Wilmington, Delaware.

Class Action Waiver

YOU AND KLOHOST AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Exceptions

Either party may seek emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration. Claims related to intellectual property infringement may also be brought in court.

13. Changes to Terms

KloHost reserves the right to modify these Terms at any time. We will notify you of material changes by:

• Sending an email to the address associated with your account
• Posting a prominent notice on our website
• Updating the "Last Updated" date at the top of this page

Changes will take effect 30 days after notification for existing customers, or immediately for new customers. Your continued use of the Services after the effective date constitutes acceptance of the revised Terms.

If you do not agree to the revised Terms, you must stop using the Services and cancel your account before the effective date of the changes.
